Certificate of Professional Competence – Introduction

To understand the Certificate of Professional Competence, & its importance to the area of transport management, firstly an understanding of the term Professional Competence. Professional Competence in relation to transport regulations, means that the individual or an entity formally recognised as being competent in the managing of transport operations in a professional & compliant manner. This is often referred to within the Operator Licensing Regulations as being able to Demonstrate Professional Competence.

Certificate of Professional Competence: Who Needs to Demonstrate Professionally Competence 

Road transport operators who operation is considered by the Operator Licensing Regime as working for “hire or reward”, at either nationally or internationally. Must operate under the authority of any Standard Operators Licence. Part of the requirements for the holding of a Standard Operators’ Licence, is the holder must demonstrate Professional Competence. Along with a suitable qualified person, to act as the nominated Transport Manager. I.e. a person who is the holder of a Certificate of Professional Competence, or more commonly known as a CPC Holder.

Therefore, any application for a Standard Operator’s Licence must include the nomination of a person. Who is considered as being suitable qualified, as per the Operator Licensing Regulations. So that Professional Competence can be Demonstrated by the Standard Operators Licence applicant/holder.

Certificate of Professional Competence: How is Professional Competence Demonstrated

Any party applying for a Standard Operators’ Licence needs to demonstrate Professional Competence, not only for the application process but at all times when the Standard Operator’s Licence is considered as valid. Professional Competence can only be demonstrated through a natural person, it cannot be demonstrated by an entity such as a limited company holding a Certificate of Professional Competence. They must also have a genuine direct link with the Standard Operators Licence Holder.

As a CPC or Certificate of Professional Competence Holder, they are formally recognised as having Professional Competence in road transport compliance management. The demonstrating Professional Competence in road transport compliance management. Is a basic requirement for those parties looking to hold a Standard Operators Licence.

Therefore, with the way in which the Operating Licensing Regulations define how Professional Competence has to be demonstrated. There are only two ways in which Professional Competence, can be demonstrated by an applicant/holder of a Standard Operators’ Licence.

Certificate of Professional Competence: Demonstrating Professional Competence Directly

If the applicant/holder is also the holder of a Certificate of Professional Competence, then they can also act as the nominated Transport Manager, as they would be considered as being suitable qualified person. This is true of parties such as a sole trader or a partner in a partnership as the Certificate of Professional Competence Holder will be a physical person & not an entity.

However, commercial entities such as a limited company, can hold a Standard Operator’s Licence in its own right. So how is the demonstrating Professional Competence achieved, by a commercial entity such as a limited company, as is not a physical person? Professional Competence can be demonstrated directly in the case of a limited company, by one of the company director’s being the holder of a Certificate of Professional Competence or CPC Holder, then as before this makes them a person who is suitable qualified person to act as the nominated Transport Manager. On the Standard Operators Licence

As stated above, Professional Competence can be demonstrated by an applicant/holder of a Standard Operators’ Licence in two ways. Please see below the second way that Professional Competence can be demonstrated, by the holder of a Standard Operator’s Licence.

Certificate of Professional Competence: Demonstrating Professional Competence In-Directly

Along with the method shown above the Standard Operators Licence applicant/holder can demonstrate Professional Competence is by the employing of a person who is the holder of a Certificate of Professional Competence or CPC Holder. They can be an employee, director, company secretary, owner or shareholder. If this is the case, the holder of the Transport Manager CPC is known as an Internal Transport Manager.

The Standard Operators Licence applicant/holder may also engage the holder Certificate of Professional Competence Holder, to act as the nominated Transport Manager. Under freelance (Sub-Contract/Self-Employed) conditions. This is formally referred to as being an External Transport Manager. If this is the case, the prerequisite of a genuine, & direct link to the Operators’ Licence, which he/she is nominated on, is still applies. This is normally done via a Contract of Services

This last method of demonstrating Professional Competence has now become very popular with applicants/holders of Standard Operator’s Licence which is considered as being a small to medium size fleet. The main reason for this is due to the cost savings that can be made.
